This user agreement is the first edition terms and conditions effective as of 1st November 2008, and applies to all users who have registered on, or after this date. Any further amendments will be uploaded and previous editions archived.

The aim of these terms and conditions are you provide you with information on the service that KitRaider offers you as a member of the auction site. We strongly advise that, prior to becoming a member of the KitRaider site, you read and accept the below Terms and Conditions. This is the principle user agreement and constitutes a legally binding contract between you and KitRaider.

General Terms and Conditions
This web-site is intended to be a friendly, enjoyable and useful experience, but as with anything concerning any kind of transactions there are risks involved and we strongly advise you to understand all of these terms before joining. If you spot a listing that you feel is violating the general terms and conditions of this web-site as stated below please let us know by contacting us.

This site acts as the window for sellers to conduct auctions and for bidders to bid on sellers' auctions. The site aims to encourage the best quality sports equipment to be uploaded onto the site and traded. However, KitRaider is not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items listed the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. We cannot and do not, control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on. Please note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretence.

KitRaider shall not be responsible for any items sold by Auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. KitRaider shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained. KitRaider assumes no liability for the content of the listings; however if you fall victim of a fraudulent transaction we will assist you as much as we can.

These terms and conditions have been written for users to adhere to, to ensure a positive experience for all members of the KitRaider website. KitRaider members are not allowed to use, or post, the following onto the website:

1a Content
• post, list or upload content or items in an inappropriate category
• breach any laws (see section 4 regarding law)
• sell any counterfeit items
• infringe the copyright, trade mark or other rights of third parties
• breach KitRaider policies
• post false, inaccurate, misleading, or libellous content
• copy, modify, or distribute rights or content from KitRaider, services or tools or KitRaider's copyrights and trademarks

1b Conduct
NB: All sellers are advised to retain proof of delivery.

• fail to deliver payment for items purchased by you, unless:
• fail to deliver items purchased from you, unless:
• manipulate the price of any item
• interfere with other user's listings
• influence KitRaider's fee structure, billing process, or fees owed to KitRaider
• undermine the feedback or ratings systems
• transfer your KitRaider account to another party without our consent
• distribute unsolicited or bulk electronic communications (see section 5 on spam)
• distribute viruses or any other technologies that may harm KitRaider or its members
• collect information about users, including email addresses, without their consent

2 Rights To Suspend or Terminate
You agree that this web-site, in its own discretion, may terminate any auction or use of the service immediately and without notice if:

a) We believe that you are not abiding by the general rules of this web-site
b) You have repeatedly broken a certain term
c) You have listed a suspicious item
d) We believe you to be a non paying bidder. In most cases when we suspect foul play we will suspend your account/listing whilst we investigate further. If our investigation is conclusive then your account with us will be terminated.

3a Individual Membership
Membership to KitRaider is only available to those who can form a legally binding contract. KitRaider does not permit membership of people under the age of 18. If any member fails to signup with their correct age the account will be terminated immediately.

3b Business Membership
Business users registering with KitRaider must ensure they have the authority to legally bind that entity. If you are trading as a business on KitRaider, you must comply with all applicable laws relating to online trading.

4 Laws
This User Agreement is governed by and constructed in accordance with the laws of England and Wales and any disputes will be decided only by the Courts of England and Wales. We will commence supplying our services to you as soon as you accept this Agreement. Unless you and KitRaider agree otherwise, you will not be able to cancel this Agreement under the Consumer Protection (Distance Selling) Regulations 2000 (or any equivalent legislation in your jurisdiction) once the supply of the services has commenced.

5 Spam Policy
KitRaider does operates an anti-spam policy and does not tolerate members using KitRaider as a means of distributing unsolicited communication. You must ensure you have consent of any other KitRaider user before adding their contact details to any mailing lists you control. We do not permanently store emails or email addresses for any marketing purpose, unless we have prior consent of a user.
